Committed to the values of respect, subjection to legality, reserve, confidentiality, availability, integrity and proper handling of information and especially with the conviction in the guarantee of fundamental rights through this document, it intends to comply with the Law 1266 of 2008 and Law 1581 of 2012 "Personal Data Protection Law", regulated by decree 1377 of 2013, Marketing MARCACERO with registration 3226996 of the Chamber and Commerce of Bogotá, belonging to the Circle of affiliates of the CCB (With the benefit of making business contacts between members of the CCB through the database provided by this entity) y represented by Carlos Moya with RUT 80033193-6 and license plate: 2003279 located at CALLE 154 #16D-38 OF. 103, of the city of Bogotá, informs that the personal data that is collected through this website, as well as through campaigns,   forms, events, portals and other formats used in marketing activities They will be treated in a reliable and secure manner for the following purposes: comply with the obligations derived from the contractual relationships established with the owner of the data; grant a guarantee on the products or services acquired when appropriate; inform about commercial conditions and after-sales services, among other actions derived from the business. Likewise, it is reported that the data may be delivered in a secure manner and under the direction of MARCACERO, to service providers and/or contractors, national or foreign, and in any case will be managed in a secure computer infrastructure by MARCACERO or their managers, confidentially and will not be transferred to third parties. They can also be delivered to public authorities when required in accordance with their legal authority, and they can also be consulted in databases with a public vocation for the detection of risks.

Current technologies must allow companies and/or entities the efficient management, exploitation and storage of personal information that is used to fulfill their corporate and business objectives, solely for the purposes to which it is linked and for this reason MARCA CERO will have as main object:

Additionally, the data and personal information obtained from the owner may be processed for the following purposes, if authorized by the owner:

  • To carry out marketing and business research actions, customer prospecting, market trends in relation to the personal information provided by the owner of the data.           

  • Design offers tailored to the client and their needs and invite them to participate in special events of their interest, among others.

  • Inform the customer of promotions about products, goods and services that may be of interest to them, in the same way the sending of gifts for advertising offers.

  • Send the client publicity and propaganda about the products and services.

  • To deliver personal information of the owner to subsidiaries and subordinates of MARCA CERO. 

  • To treat the data only in the development of its commercial activities related to MARCA CERO. 

Similarly, the personal data of customers, employees, service providers, suppliers, natural persons with whom there are alliances established in contracts and/or agreements, operators, distributors, third parties and in general, any natural person who owns the personal data that appear registered in the databases will be used by MARCA CERO. In order to adequately advance all its processes in the execution of the provision of its services to the community and thus comply with this manual and Law 1266 of 2008, Statutory Law 1581 of 2012 and its regulatory decrees.

 

To make effective - at any time - the rights to access, knowledge, consultation, rectification, updating and deletion of data, THE CLIENT may submit Questions, Complaints or Claims (PQR's) through the email mercadeo@marcacero.co

COMMERCIAL TERMS AND CONDITIONS:

  • Our commercial proposals establish prices with a validity of 15 days counted from the presentation of the proposal, after this time the prices will be subject to change so it will be necessary to update the proposed value. 

  • The prices of our commercial proposals will be specified for Colombia in Col Pesos and for other countries in American Dollars (USD).

  • Travel expenses, transportation, lodging, food and others that may be incurred during the provision of services, are not considered in the proposal and will be agreed with the client.

  • Web project delivery times: 3 business weeks or sooner.

  • Delivery times Brand development: 8 to 10 business days.

  • In accordance with our policies, the start date of the project will be taken from the first payment of 50% for the project.

When the estimated time of the project is exceeded due to aspects not attributable to MARCACERO, the following procedure will be followed:

  • If situations arise that alter the delivery times by the client, it will be counted from the date that the client has not provided the information or supplies, an additional 30 days will be counted to complete the project, if the client does not provide the information or supplies. to advance the project, during this time the project will be closed by MARCACERO. If the client wants to "reopen" it, he must pay an additional 20% based on the value of the proposal initially presented and a new delivery time will be reviewed with the client in accordance with the commitments made. After this time and the project is not reopened by the client, it will be taken as a new project.

  • If the client requires freezing the project, they must formally notify our email  carlosmoya@marcacero.co   the freezing of the project. If the client wants to "reopen" it, he must pay an additional 30% based on the value of the proposal initially presented and a new delivery time will be reviewed with the client in accordance with the commitments made. The maximum time to freeze a project is 30 days, after this time and the project is not reopened by the client, it will be taken as a new project.

WAY TO PAY:

Our forms of payment are: 50% to start the project – 50% at the end of the delivery of the project.

 

*Payment support for the simplified system equivalent to an invoice for the common system. [Art. 3 decree 522 of 2003].

Refrain from practicing Withholding at the Source, since in compliance with the requirements as an employee (Art 329 of the ET), my income is not greater than 300 UVT, established to make said withholding or we present a collection account and the percentage will have to be added corresponding to the final prices presented by us.

Note: Prices do not include billing costs (VAT) or withholdings, if any type of withholding is required, the corresponding percentage will have to be added to the final prices presented by us.

SERVICE GUARANTEE

We provide guarantees based on:

  • Failure to comply with delivery times on our part.

  • Bad configurations and settings on the Wix platform.​

RETURNS

  • Money is not refunded. However, the situation or the facts will be analyzed in depth and if it is due to actions that have been caused by MARCACERO, it would be contemplated en make a refund of money. The return of money would be made according to the hours remaining to those invested in the project and based on the activities carried out within the project, the value of the hour will be handled with the current rate in force.

WARRANTY OF THE TECHNOLOGY PLATFORMS

*In front of the plataforma Web Wix, the customer can request the respective guarantees or errors or changes of functionality directly with the owner of the software, through the help center, through phone call, chat or tickets:  https://support.wix.com/es/

Against third parties such as other solutions associated with the Web platform such as payment gateways or others, the client must request the respective guarantees and support directly from the help center.


After the project is approved and delivered, additional changes, misalignments or configurations executed by the client and that require re-adjusting or resetting the site to previous versions, these actions will have additional costs.

*** Important: Wix in each module has a certain coverage so the scope for the project will be based on the current function that each module of the Wix platform provides.

At the end of the training and delivery of the project, the client has the opportunity to rate our service where 1 star was not satisfactory or 5 stars the service provided was satisfactory. 

Brand service clarification: 

 

Once the brand has been delivered, it is recommended that the client register the brand with the corresponding entities. After delivery, the client is responsible for plagiarism or other actions that may occur in the submitted design.

SUPPORT

First level support: The client will be trained in the delivery of the project as an editor and first level support so that he can autonomously identify the respective errors that he may be presenting. In case of not counting within the contracted service with the training, the client can request and contract the training service of 2 Hrs, with the respective current rate.

Second Level Support: The client within his Wix account has the option through the help center to request support by phone or through tickets or Chat or lastly from the self-help center where he can through a library of questions questions or solve the problem, help center link:   https://support.wix.com/es/

Second Level Support: In the event that none of the above actions are successful, the review and analysis will be carried out by MARCACERO and, if necessary, a possible solution will be provided or, if applicable, it will be escalated to the support team or to the Wix account. of Wix to provide the respective solution.

 

Out of scope the following tasks in Web development: 

  • Rights to images, fonts and multimedia elements, animations. 

  • Retouching or design of illustrations, images and photography

  • Cost of licenses on third-party products / software. 

  • Writing or translation of texts (whether interface, messages or site content) into languages other than Spanish.

  • Content loading prior to exiting the site. 

  • Creation of animations or multimedia viewers (flash or similar) that must be provided by the client.

  • Video creation, editing or conversion. (They must be provided by the client in the final format in which they will be presented on the website).

  • Creation of APIs or webservices. 

  • Any task or activity not explicitly defined in the above. 

  • Developments or programming.
